01

What legal process outsourcing is

Defined legal or legal-support work, handed to an outside provider. The location changes the label, not the work.

Offshore

Provider in another country

Onshore

Provider in your own country

Nearshore

Provider a time zone or two away

Five models, side by side

A captive centre is not outsourcing. You built it, you staff it, you carry it.

03

What never travels

A non-lawyer may not do any of the following. In most states, crossing this line is a crime — wherever the person sits.

  • Give legal advice
  • Exercise judgment on a matter
  • Sign a pleading
  • Appear in court
  • Negotiate for a client
  • Accept or decline a representation

Allowed

Filling the factual blanks on a form

Not allowed

Advising which form to use

Everything an offshore team produces is an input. A licensed attorney reads it, adopts it, signs it. That obligation does not travel.

04

How the industry got here

Back-office processing first. Legal work followed the infrastructure.

1994

American Express opens a processing centre near Gurgaon.

1997

GE Capital International Services begins — later Genpact.

2001

GE is reported moving legal work to India.

2004

Pangea3 founded — the first pure-play legal provider at scale.

2008

ABA Formal Opinion 08-451: outsourcing is permitted.

2010

Thomson Reuters buys Pangea3, reportedly $35–40m.

2019

EY acquires Pangea3. The Big Four are in legal services.

2023

Generative AI lands in document review — the largest service line.

05

The market, and why the numbers disagree

2025 estimates run from $2bn to $31bn for the same market. One figure has a published methodology.

Philippines against India

India is the incumbent, and it is not close. Buy volume there; buy continuity in Manila.

AttritionHigher

Headcount from Evalueserve, 2010 — India ~4,900, Philippines ~300. Attrition figures come from vendors. Treat both as directional.

One correction: the Philippines is not a common-law country. It is a mixed jurisdiction — the US influence is in its legal education.

07

What it costs

Offshore: $25–80 an hour. US providers: $150–350. Both are vendor figures — the only kind published.

2–4 wks

Reduced output during ramp

Why 30–70% becomes 20–40%

  • QC eats 20–30% of the labour saving
  • Transition runs $5k–20k per function
  • Two to four weeks of slower output
  • Supervising attorney hours never moved

08

The risks, stated plainly

A general counsel raises all four in the first meeting. Here they are first.

01Rising

Confidentiality and privilege

Departments naming it a barrier went from 26% to 44% in two years.

02High

Data across borders

UCSF, 2003: a three-tier subcontract chain nobody had mapped. Ask who yours subcontracts to.

03Permanent

Supervision and malpractice

Outsourcing moves the work, not the liability. No state removes it.

04Unmeasured

Quality and rework

Half of departments cite quality as a barrier. Nobody has measured it independently.

09

The ethics

Settled since 2008. The burden, not the permission, is the open question — and it sits with the US lawyer.

10

What generative AI changes

One camp says AI removes the arbitrage. The other says it makes providers more capable. The evidence supports both.

01

The work arrives

Documents, contracts, records. The volume that started all this.

02

AI takes the first pass

41% of firms and 47% of departments now use it — up from 28% and 23%.

03

A person checks it

Over half expect more of this work to move outside, not less.

04

The lawyer still signs

ABA Opinion 512 extends the same duties to AI. The signature is yours.

11

Questions we get asked

Is legal process outsourcing ethical?

Yes. ABA Opinion 08-451, 2008. Conditions: supervise, protect confidentiality, get consent, do not assist UPL.

Do I have to tell my client?

If the provider sees confidential material, yes — and get consent. Tell them anyway, and record it.

LPO or BPO — what is the difference?

LPO is the legal subset of BPO. It carries supervision, confidentiality, conflicts and the UPL line.

Does it actually save money?

Yes, less than advertised. 20–40% realised against 30–70% quoted, once QC, transition and supervision are counted.

Can an offshore paralegal give legal advice?

No. That is UPL, a crime in several states. They produce inputs; an attorney reviews, adopts, signs.

How large is the market really?

Unknown for LPO alone. The one measured figure is $28.5bn for alternative legal services, 2023.

Philippines or India?

India for volume and price. The Philippines for English, US-influenced training and lower attrition.

What if the person assigned to us leaves?

Philippine law allows resignation on thirty days. Your protection is the replacement guarantee and where the work product lives.

Will AI make this redundant?

Nobody knows. Review is the most exposed line; more than half still expect work to move outward. Both are true today.

If you want the version specific to your firm

Everything above is general. What you can safely delegate depends on your practice area and review capacity.
